A MESSAGE
FROM EXECUTIVE DIRECTOR TONY HOANG
Dear friends, 2021 was another challenging year for the LGBTQ+ community — and for the diverse communities to which we belong — as we continued navigating a global pandemic; reckoning with our nation’s history of racial injustice and a surge in anti-Asian hate; and contending with a ridiculously expensive and wasteful statewide recall election. But here in California — in the face of these trying conditions — we were able to make great progress. While states across the nation pursued and passed policies attacking the transgender community, the California Legislature invested in the health and well-being of trans and gender-nonconforming people and adopted legislation to better respect and affirm Californians’ gender identities. From streamlining the processes that transgender people can use to change their names on marriage certificates, college diplomas and their children’s birth certificates to allowing nonbinary people’s identities to be recorded accurately on death certificates, these advancements are a testament to the dedicated activists who inspire us with their stories, integrity and perseverance. We passed legislation to ensure older Californians living with HIV have access to the programs and services they need, and we worked to repeal California’s racist, transphobic law against loitering with the intent to engage in sex work — which encourages law enforcement to profile and harass LGBTQ+ people and communities of color. And we secured an historic $3 million budget allocation to create an online training that will equip teachers and school staff with the information and resources that they

need to support LGBTQ+ students and improve overall school climate. During this period, I had the honor and privilege to succeed my friend Rick Chavez Zbur as Equality California’s new executive director. I’m grateful for this responsibility and am excited to build on his legacy alongside a talented staff and boards of directors, incredible partners and hundreds of thousands of members across our state. For all that we accomplished in 2021, we recognize that considerable work is left to be done. We need to reform our criminal justice system and advance racial equity. We need to expand access to quality, affirming healthcare and safe and supportive public schools. We need to safeguard abortion access and reproductive freedom and ensure that LGBTQ+ people have an equal opportunity to build families. We need to end the COVID-19 and HIV pandemics and solve our homelessness crisis with the urgency and compassion it demands. We need to create a world that is healthy, just and fully equal for all LGBTQ+ people. No matter the difficulty of achieving these goals, I am motivated by the dogged determination to achieve full, lived equality that I see in each of you — our partners in Sacramento — and in diverse communities across California. That commitment sets us apart as a state, and I have faith that it will continue to serve as an example for the rest of the country and for the world.

THANK YOU, LEGISLATIVE LGBTQ CAUCUS As one of the nation’s largest, most diverse caucuses of openly LGBTQ+ state legislators, the California Legislative LGBTQ Caucus has continued to pave the way toward a world that is healthy, just and fully equal for all LGBTQ+ people. In 2021, under the leadership of its Chair, Assemblymember Evan Low (D-Silicon Valley), and Vice Chair, Senator Susan Talamantes Eggman (D-Stockton), the Caucus championed many of Equality California’s legislative priorities. Equality California is grateful to the nine Caucus members and their staff, including consultants Alina Hernandez and Jacob Fraker. We look forward to continuing to grow the Caucus in 2022 to ensure that the LGBTQ+ community is well-represented in the Capitol.

PRIORITY SCORED LEGISLATION Working closely with members of the California Legislative LGBTQ Caucus and other pro-equality legislators in 2021, Equality California sponsored 10 bills, of which 6 were signed into law by Governor Gavin Newsom. We also led the advocacy effort for one budget request that was adopted by the Legislature and signed by Governor Newsom. Our sponsored legislation took on a wide range of issues that will help advance the health and well-being of the LGBTQ+ community and the diverse communities to which LGBTQ+ people belong. SPONSORED BILLS Affirming Records AB 218 by Assemblymember Chris Ward (D-San Diego) AB 218 codifies and streamlines the process for transgender Californians to update their marriage certificates and their childrens’ birth certificates to accurately reflect their legal name and gender, while protecting their privacy. Accurate and affirming identity documents are critical to preventing discrimination when, for example, enrolling a child in school, applying for a loan, or making medical decisions on behalf of an incapacitated spouse. Status: Signed by Governor Newsom.
Affirming Transgender & Nonbinary Students’ Names in College Act AB 245 by Assemblymember David Chiu (D-San Francisco) AB 245 ensures that California’s public colleges and universities allow transgender and nonbinary former students to 6 | Equality California 2021 State Legislative Scorecard

“AB 439 ensures that nonbinary people will be respected and remembered as who they were.” Asm. Rebecca Bauer-Kahan (D-Orinda)
have their name and gender accurately reflected on their academic records, such as transcripts and diplomas. The bill also provides a standardized process for doing so. Students should not be ‘deadnamed’ – referred to by the name they were assigned at birth, rather than by their affirmed or chosen name – on their diplomas and other academic records that commemorate years of hard work and achievement. AB 245 builds upon AB 711 (Chiu), signed in 2019, which applied to school districts, charter schools, and county offices of education. Status: Signed by Governor Newsom.
Nonbinary Option for Death Certificates AB 439 by Assemblymember Rebecca Bauer-Kahan (D-Orinda) AB 439 adds “nonbinary” as an option for gender identity on death certificates. Codifying inclusive gender identity options on death certificates brings these documents in line with California’s existing nonbinary options on driver’s licenses and birth certificates. AB 439 continues the work started by Senate Pro Tem Toni Atkins to authorize nonbinary identification on birth certificates, court documents, and driver’s licenses (SB 179 in 2017) and to ensure that California respects people’s gender identity even after death (AB 1577 in 2014). Status: Signed by Governor Newsom.
Cultural Competency Training for Professional Fiduciaries AB 465 by Assemblymember Adrin Nazarian (D-Los Angeles) AB 465 ensures that professional fiduciaries are more equipped to provide LGBTQ+ older adults and people with disabilities with supportive and respectful services via LGBTQ+ cultural competency and sensitivity training. Private professional fiduciaries manage daily care, housing, and medical needs and offer financial management services ranging from basic bill payments to estate and investment management. LGBTQ+ older adults are a particularly vulnerable community and typically have fewer options for informal care and support. Status: Signed by Governor Newsom. Leave for Chosen Families AB 1041 by Assemblymember Buffy Wicks (D-Oakland) AB 1041 would expand the definition of “family member” for purposes of family caregiving and sick leave to allow workers to use existing time off to care for a “designated person,” thereby creating equitable access to job-protected family caregiving and sick leave for all of California’s working families. Status: Awaiting a vote on the Senate floor in 2022.
Recovery Incentives Act SB 110 by Senator Scott Wiener (D-San Francisco) SB 110 would have expanded access to contingency management (CM) programs. CM is a substance use disorder treatment that uses positive reinforcement to achieve behavioral change. CM has proven to be an effective method of intervention for methamphetamine disorder, in light of the fact that there is currently no medication-assisted treatment for methamphetamine use disorder. CM is therefore a critical tool in addressing meth and other stimulant use. Meth use is a longstanding crisis in the LGBTQ+ community due to historical and ongoing stigma, shame, and marginalization. SB 110 is an important pillar in California’s response to this public health crisis. Status: Vetoed by Governor Newsom.
HIV & Aging Act SB 258 by Senator John Laird (D-Santa Cruz) SB 258 includes older people with HIV as part of the population of “greatest social need” to ensure they have access to the programs and services administered by the California Department of Aging. With recent advancements in HIV treatment, people with HIV who take antiretroviral therapy can keep the virus suppressed and live long and healthy lives. For this reason, the number of older people living with HIV is increasing and over half of people living with HIV in California are now aged 50 years or older. Unfortunately, our current medical and social service systems are largely unprepared to address the unique needs of this population. Given the continued growth in the number of older people with HIV, it is imperative that California implement effective policies and programs to address their unique needs. Status: Signed by Governor Newsom.
Strengthening the Equal Insurance HIV Act of 2020 SB 283 by Senator Lena Gonzalez (D-Long Beach) SB 283 strengthens the Equal Insurance HIV Act of 2020 through clarifying and technical changes. The Equal Insurance HIV Act of 2020 prohibits an insurer from declining an insurance application or enrollment solely based on an applicant’s positive HIV test. Status: Signed by Governor Newsom.
Safer Streets for All Act SB 357 by Senator Scott Wiener (D-San Francisco) and Assemblymember Ash Kalra (D-San Jose) Senate Bill 357 would repeal a law that criminalizes loitering with the intent to engage in sex work. SB 357 would also enable people who have been convicted of loitering with the intent to engage in sex work to seal their records. Existing law has contributed to unjust discrimination on the basis of gender, race, class and perceived sex worker status – in particular, targeting Black women and members of the transgender community. SB 357 would protect vulnerable populations from profiling and discriminatory enforcement. Status: Passed Assembly and Senate and eligible for Governor Newsom’s signature in 2022.

BILLS SCORED BUT NOT SPONSORED AB 1094 by Assemblymember Joaquin Arambula (D-Fresno) AB 1094 requires the California Department of Public Health to establish a three-year pilot program in up to six counties for the collection of sexual orientation and gender identity data in cases of violent death. The data gathered through AB 1094 will benefit those who seek to address California’s public health concerns, including violence against the transgender community, LGBTQ+ youth suicidal ideation, and fatal interactions with law enforcement. Status: Awaiting a vote on the Senate floor in 2022.

BILLS & BUDGET REQUESTS SPONSORED BUT NOT SCORED Equitable and Inclusive UC Healthcare Act SB 379 by Senator Scott Wiener (D-San Francisco) and Assemblymembers Evan Low (D-Silicon Valley) and Cristina Garcia (D-Bell Gardens) SB 379 would ensure that the University of California Health System (UC Health) does not enter into contracts that prevent UC Health doctors and medical students from providing non-discriminatory and inclusive healthcare services, including reproductive and gender-affirming care. Status: Passed by Senate Education Committee and Senate Health Committee.
Safe & Supportive Schools Budget Proposal
Equality California led the advocacy effort to secure funds in the 2021-2022 budget to create an online training that will equip teachers and school staff with the information and resources that they need to support LGBTQ+ students and improve overall school climate. Status: Signed by Governor Newsom.
Bodily Autonomy, Dignity and Choice Act SB 225 by Senator Scott Wiener (D-San Francisco) SB 225 would delay specified medically unnecessary surgeries on children born with variations in their physical sex characteristics. This bill does not affect surgeries that are required to address an immediate risk of physical harm, and it does not remove parents or doctors from the medical decision-making process. The bill builds upon SCR 110 (Wiener), which in 2018 called on health professionals to foster the well-being and individuality of children born with variations in their physical sex characteristics and to heed international human rights guidelines and health authorities in the United States that caution against medically unnecessary surgical procedures that pose a significant risk of harm and can be safely deferred. Status: Withdrawn from consideration in Senate Committee on Business, Professions & Economic Development due to lack of support.

BILLS SUPPORTED BUT NOT SCORED In addition to the bills listed above, we supported a host of bills that have an impact on our mission of creating a world that is just and equal for all people. These pieces of legislation had significant impacts on LGBTQ+ people and the diverse communities to which we belong. We decided to feature these pieces of legislation because they help to provide an overall picture of the breadth of issues on which we engage in Sacramento. AB 746 by Assemblymember Sabrina Cervantes (D-Riverside) LGBTQ+ couples frequently experience adoption barriers ranging from legal roadblocks to stigma held by adoption professionals. AB 746 reduces these barriers by eliminating requirements relating to minimum marriage duration and the provision of income and education verification as prerequisites to stepparent adoption. This ensures that parentage laws reflect and further protect all families in our state. Status: Signed by Governor Newsom.
AB 1184 by Assemblymember David Chiu (D-San Francisco) Confidentiality is of utmost importance when a patient is accessing healthcare, especially sensitive services. AB 1184 protects patient confidentiality by expanding the definition of sensitive services to include gender-affirming care and mental and behavioral healthcare. AB 1184 also ensures that patients have a pathway to request confidential communications from their insurers and are informed of their right to do so. Status: Signed by Governor Newsom.
SB 395 by Senator Anna Caballero (D-Salinas) Tobacco use is a leading cause of preventable, premature death for adults in the United States and around the world, and LGBTQ+ people are up to four times more likely to use tobacco products than their peers. California’s LGBTQ+ high school students use vape products at higher rates than their peers, and low quit rates and high use rates for LGBTQ+ people mean that we need to focus on prevention and making it more difficult for future generations to become addicted to nicotine. SB 395 will close a tobacco product tax loophole by adding a tax on electronic cigarettes, thereby creating more parity between taxes associated with the sale of vape products and traditional tobacco products. Status: Signed by Governor Newsom.
SB 2 by Senator Steven Bradford (D-Gardena) SB 2 increases accountability for peace officers that commit specified misconduct, thereby protecting vulnerable communities. The famous Stonewall Riots of 1969 were led by queer and transgender women of color to protest police brutality and misconduct against the LGBTQ+ community, and fifty years later, there is still work to be done. Of survivors of anti-LGBTQ+ violence who have interacted with police, 48% report experiencing police misconduct. According to the 2015 U.S. Transgender survey, 58% of respondents reported that, when they interacted with police officers who knew they were transgender, they experienced verbal harassment, persistent misgendering, physical assault, being forced to perform sexual acts to avoid arrest, and other mistreatment. Holding officers accountable when they engage in misconduct will reinforce public safety and help to rebuild community trust. Status: Signed by Governor Newsom.
SB 16 by Senator Nancy Skinner (D-Berkeley) SB 16 expands public access to records on law enforcement officers who have engaged in unreasonable and excessive use of force or failure to intervene against it, unlawful arrests and searches, or prejudicial or discriminatory conduct. The bill also helps to ensure that past misconduct cannot so easily be hidden. Transparency increases public safety and translates into solutions that are targeted to address root problems and are therefore more effective. Status: Signed by Governor Newsom.

2021 Methodology In the scorecard that follows, the analysis of votes is based primarily on the final floor votes cast on the measures. “Yes” votes on scored legislation are represented by “+” and “no” votes are represented by “-.” Legislators who are present but not voting are denoted by an “A” for “abstaining,” which is scored as equivalent to a “no” vote on sponsored or supported legislation. Passage of legislation typically requires a “yes” vote by the majority of all legislators, so failing to cast a vote has the same effect as a “no” vote. Legislators who were officially absent for a vote did not have that vote factored into their rating and are denoted on the scorecard with an “E” for “excused.” Missed votes on scored legislation may be excused if the legislator was a co-author, voted to support the legislation at a previous floor vote or in committee, or was absent from the floor on official business. aThe overall score reflects legislators’ votes on Equality California-sponsored legislation and priority supported legislation (highlighted in RED). Highlighted in YELLOW are bills that Equality California supported but did not factor into this year’s scoring. The votes in YELLOW are included for informational purposes only.
